1. Acceptance of Terms

By accessing or using the website operated by IT Education Canada Ltd. ("we," "us," or "our") at iteducationcanada.ca (the "Site"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree with any part of these Terms, you must discontinue use of the Site immediately.

You must be at least 16 years of age to use this Site. If you are under 16, you may only use the Site under the supervision of a parent or legal guardian who agrees to be bound by these Terms on your behalf.

These Terms incorporate by reference our Privacy Policy, which describes how we collect, use, and protect your personal data. By using the Site, you also acknowledge that you have read and understood the Privacy Policy.

2. Educational Information Disclaimer

IT Education Canada Ltd. is an informational resource and educational guidance platform. The content on this Site — including program descriptions, tuition estimates, salary figures, immigration pathway information, career guidance, and scholarship details — is provided for general informational purposes only.

We are not a designated learning institution (DLI), a registered immigration consultancy under the College of Immigration and Citizenship Consultants (CICC), or a licensed career counselling service. The information provided on this Site does not constitute professional immigration advice, legal advice, financial advice, or a guarantee of admission to any educational institution.

Program details, tuition fees, admission requirements, and immigration policies are subject to change at any time by the respective institutions and government bodies. We make reasonable efforts to keep information current, but we cannot guarantee the accuracy, completeness, or timeliness of any information on the Site. You should always verify details directly with the relevant institution, Immigration, Refugees and Citizenship Canada (IRCC), or a licensed professional before making educational, immigration, or financial decisions.

3. Description of Services

The Site provides the following services on an "as is" and "as available" basis:

4. Acceptable Use

You agree not to engage in any of the following prohibited activities when using the Site:

We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Site for personal, non-commercial purposes. This licence does not include the right to:

  • Reproduce, distribute, or publicly display any content from the Site without our prior written permission
  • Modify, adapt, or create derivative works based on the Site content
  • Use any data mining, robots, or similar data-gathering methods to collect content from the Site
  • Use the "IT Education in Canada" name, logo, or any associated trademarks without written authorisation

Third-party institution names, logos, and trademarks referenced on the Site belong to their respective owners and are used for identification purposes only. Their inclusion does not imply endorsement by or affiliation with IT Education Canada Ltd.

6. Third-Party Services and Links

The Site may contain links to third-party websites, including educational institutions, government agencies (such as IRCC), scholarship providers, and other external resources. These links are provided for your convenience and informational purposes only.

We do not control, endorse, or assume responsibility for the content, privacy policies, or practices of any third-party websites. Accessing third-party sites is entirely at your own risk, and you should review their respective terms and privacy policies before providing any personal information or relying on their content.

7. Disclaimer of Warranties

THE SITE AND ALL CONTENT, TOOLS, SERVICES, AND INFORMATION PROVIDED THROUGH IT ARE OFFERED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED.

To the fullest extent permitted by applicable law, IT Education Canada Ltd. expressly disclaims all warranties, including but not limited to:

  • Implied warranties of merchantability, fitness for a particular purpose, and non-infringement
  • Warranties that the Site will be uninterrupted, error-free, secure, or free of viruses or harmful components
  • Warranties regarding the accuracy, reliability, completeness, or timeliness of any content, including program information, tuition estimates, salary data, immigration guidance, or scholarship details
  • Warranties that use of the Site will result in admission to any institution, approval of any immigration application, or attainment of any particular employment outcome

8. Limitation of Liability

To the maximum extent permitted by applicable law, IT Education Canada Ltd., its directors, officers, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with:

  • Your use of or inability to use the Site
  • Any errors, inaccuracies, or omissions in the content provided
  • Any decisions you make based on information obtained through the Site, including educational, immigration, financial, or career decisions
  • Any unauthorised access to or alteration of your data or transmissions
  • Any third-party content, products, or services accessed through the Site

In no event shall our total aggregate liability for all claims arising from or related to the Site exceed the greater of: (a) the total amount you paid to us in the twelve (12) months preceding the event giving rise to the claim, or (b) one hundred Canadian dollars (CAD $100).

9. Indemnification

You agree to indemnify, defend, and hold harmless IT Education Canada Ltd. and its directors, officers, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or related to:

  • Your use of the Site or any breach of these Terms
  • Any content or information you submit through the Site
  • Your violation of any applicable law, regulation, or third-party right

10. Force Majeure

IT Education Canada Ltd. shall not be liable for any failure or delay in performing its obligations under these Terms where such failure or delay results from circumstances beyond our reasonable control, including but not limited to: natural disasters, acts of war or terrorism, pandemics, epidemics, government actions or regulations, internet outages, telecommunications failures, cyberattacks, cloud service provider outages, power failures, labour disputes, or supply chain disruptions.

11. International Use

The Site is operated from Toronto, Ontario, Canada. We make no representation that the Site or its content is appropriate, lawful, or available for use in any jurisdiction outside of Canada. If you access the Site from outside Canada, you do so at your own initiative and are responsible for compliance with local laws. The information regarding Canadian immigration, education, and employment is intended to describe processes as they apply within the Canadian context and should not be taken as applicable to any other jurisdiction.

12. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any legal action or proceeding arising under these Terms shall be brought exclusively in the courts of competent jurisdiction located in Toronto, Ontario, Canada.

If you are a consumer residing in the European Union, you retain any mandatory consumer protection rights granted under the law of your country of residence. Nothing in these Terms affects your rights as a consumer to rely on such mandatory provisions of local law.

13. Dispute Resolution

Before initiating any formal legal proceedings, you agree to attempt to resolve any dispute with us informally by contacting us at [email protected] with a written description of your complaint. We will endeavour to resolve the matter within thirty (30) days of receipt.

If an informal resolution is not reached within 30 days, either party may pursue the dispute through the courts described in Section 12. If you reside in the European Union, you may bring proceedings in the courts of your country of residence in accordance with applicable consumer protection laws.

14. Termination

We may suspend or terminate your access to the Site at any time, with or without cause, with or without notice, if we reasonably believe you have violated these Terms or engaged in conduct that is harmful to the Site, its users, or IT Education Canada Ltd.

Upon termination, the following sections of these Terms shall survive and remain in full force and effect: Intellectual Property (Section 5), Disclaimer of Warranties (Section 7), Limitation of Liability (Section 8), Indemnification (Section 9), Governing Law and Jurisdiction (Section 12), and any other provisions that by their nature should survive termination.

15. Severability

If any provision of these Terms is found by a court of competent jurisdiction to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent as closely as possible.

16. Entire Agreement

These Terms of Service, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and IT Education Canada Ltd. regarding your use of the Site. These Terms supersede all prior or contemporaneous communications, proposals, and agreements — whether oral, written, or electronic — between you and us with respect to the Site.

17. Assignment

IT Education Canada Ltd. may assign, transfer, or delegate its rights and obligations under these Terms to any third party without your consent, including in connection with a merger, acquisition, corporate restructuring, or sale of assets. You may not assign or transfer your rights or obligations under these Terms without our prior written consent.

18. No Waiver

Our failure to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by IT Education Canada Ltd.

19. Modifications to These Terms

We reserve the right to modify these Terms at any time. Material changes will be announced via a prominent notice on the Site at least fourteen (14) days before the updated Terms take effect. The "Last Updated" date at the top of this page will be revised with each modification. Your continued use of the Site after the effective date of the revised Terms constitutes acceptance of the changes. If you do not agree with the modified Terms, you must stop using the Site.

20. Electronic Communications

By using the Site and submitting information through our forms, you consent to receiving electronic communications from us, including email responses to your inquiries, informational newsletters (only if you have opted in), and notices about changes to these Terms or our services. You agree that all agreements, notices, disclosures, and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing, in accordance with Canada's Personal Information Protection and Electronic Documents Act (PIPEDA), the European Union's eIDAS Regulation, and the United States' E-SIGN Act, as applicable.
